He v. Fan, 2025 BCSC 1517: Credibility and the Coercion Allegation

We continue our discussion of He v. Fan, 2025 BCSC 1517 by examining the Court's credibility findings and its dismissal of the respondent's coercion allegation.

In high-conflict family litigation, credibility is often one of the most important issues before the Court. Allegations of coercion, threats, and manipulation must ultimately be tested against objective evidence and the overall probabilities of the case.

The Coercion Allegation

The respondent alleged that he signed the 2021 Divorce Agreement in China only because he had been threatened by the claimant and feared violence from her family. After conducting a detailed credibility analysis, the Court rejected those allegations.

At trial, Cameron Lee of Henderson & Lee Law Corporation acted for the claimant and presented the documentary and testimonial evidence relevant to the parties' competing accounts.

The Court's Credibility Analysis

Justice Morley carefully compared the parties' testimony with contemporaneous WeChat messages, documentary evidence, the internal consistency of their accounts, and the probabilities of the case as a whole.

The Court did not simply accept one party's entire account. It expressed serious concerns about the credibility of both parties and approached their uncorroborated testimony with skepticism. On disputed points, contemporaneous documents were therefore especially important.

On the specific coercion allegation, the Court found the alleged threat inherently implausible, noted that there was no contemporaneous record of the accusation, and concluded that the allegation had been fabricated to escape the 2021 Divorce Agreement.

The Court also found that the contemporaneous communications were inconsistent with the respondent's claim that he had acted out of fear. Those messages instead showed him as the more aggressive party in the relevant interactions.
