Written Preparation and Responsive Oral Advocacy

Successful appellate advocacy includes more than a single decisive moment. It begins before the first steps are taken in an appeal, with a careful review of the trial decision and record. It then extends through the appeal process, including the judicious selection of issues on appeal and the preparation of a focused written factum, and continues through oral argument at the hearing.
In Fan v. He, 2026 BCCA 289, our lawyer Chen Shen of Henderson & Lee Law Corporation represented the respondent in an appeal arising from complex family litigation involving several alleged agreements, significant property interests, and continuing financial issues. The British Columbia Court of Appeal dismissed the appeal in its entirety.

Focused Written Advocacy
As the respondent, we could not choose and narrow the issues on appeal. However, in responding to each issue raised by the appellant, we tried to refocus and reframe each issue to distill the central point where possible. In the final analysis, the Court organized the complaint into five main issues with several sub-issues.
This is a large number of issues. Both the appellant and respondent had to divide their focus in addressing them, which meant that no single issue could be developed as thoroughly as it might have been if the appeal had been more focused. The final judgment also reflects that the Court gave relatively brief discussion to each issue in dismissing them.
This case demonstrates why appellate arguments should be carefully selected. Raising a large number of grounds without sufficiently developing them can make an appeal less focused and risks obscuring the central question: whether the trial judge committed a reviewable error. Effective appellate advocacy requires counsel to identify the arguments that genuinely justify intervention and present them clearly and concisely.

Responsive Oral Advocacy
The groundwork of the written factum also gave us room to react and focus on live issues at the oral hearing. This combination of detailed written submissions and responsive oral advocacy helped defend the trial judgment and preserve the respondent's successful result.
