Family Violence Allegations Become Central to Parenting Litigation

In high-conflict family cases, allegations of family violence can dramatically affect parenting arrangements, credibility findings, and the overall outcome of the litigation.

We use Wang v. Mitchell, 2024 BCSC 988 as an example to show how the BC Supreme Court approaches parenting issues when family violence allegations are highly contested. Cameron Lee of Henderson & Lee Law Corporation represented the claimant in this litigation.

Contested Allegations and Evidence

In this case, both parties accused the other of being the aggressor. The Court reviewed a substantial body of evidence, including oral testimony, police involvement, criminal proceedings, parenting exchange incidents, text and WeChat communications, surreptitious video recordings, witness testimony, and the broader history of the relationship.

In particular, before the commencement of this family action, the respondent had obtained a temporary custody order relating to the children by reporting to the police and providing several video recordings to support his allegations.

Credibility and the Children’s Best Interests

At trial, the Court carefully examined whether the evidence was internally consistent, supported by independent evidence, consistent with surrounding circumstances, and credible when viewed as a whole. Justice Marzari emphasized that family violence findings cannot be based solely on allegations or emotional accusations.

The Court also analyzed how conflict between the parents affected the children’s emotional well-being, parenting arrangements, and the parties’ ability to cooperate in the children’s best interests. Importantly, the judgment demonstrates that BC courts will closely scrutinize credibility, recordings and electronic communications, prior conduct, surrounding context, and the practical realities of the family relationship.

Ultimately, the Court did not believe the claimant posed a danger to the children and decided that the parties should share parenting time equally.
