In high-conflict family litigation, the outcome often depends not only on the law, but on which evidence the Court ultimately believes.


Henderson & Lee Law Corporation represented the claimant in the case of Wang v. Mitchell, 2024 BCSC 988, where the Court faced dramatically conflicting accounts involving family property, hidden finances, alleged trusts, business ownership, parenting, family violence, and competing allegations of fraud and deceit. Justice Marzari emphasized early in the judgment that credibility and reliability were central to nearly every issue in dispute.

At trial, Ms. Cameron Lee, on behalf of the claimant, carefully presented detailed documentary evidence, financial records, oral testimony, WeChat communications, business documents, and the surrounding probabilities of the parties' conduct.


The Court repeatedly assessed whether witness testimony was internally consistent, consistent with independent evidence, and consistent with what a practical and informed person would reasonably expect in the circumstances. The Court examined not only what witnesses said, but whether their version of events made sense when viewed against the evidence as a whole.

Ultimately, the Court rejected significant portions of the respondent's evidence regarding alleged family trusts, ownership of Chinese assets, and aspects of his personal relationships and financial dealings. The Court instead accepted the evidence of the claimant, her mother, corporate counsel, and other witnesses where their testimony was supported by documentary records and consistent surrounding circumstances.


This case demonstrates an important reality of litigation: documents matter, consistency matters, and credibility matters.
